Standard Terms & Conditions of Sale / Service
Applies to septic pumping, inspection, repair, excavation, installation, and related services unless a separately signed job-specific agreement says otherwise. By booking, accepting service, signing an estimate/order, or paying an invoice, Customer agrees to these terms.
- Agreement controls. These Terms control over Customer’s purchase orders or terms. Changes are valid only if Affordable Home Septic LLC (“AHS”) agrees in a signed writing (or written text/email confirmation from AHS).
- Scope of work. Work is limited to what is stated on the estimate, work order, ticket, invoice, or text/email confirmation. Hidden conditions, extra hose, locate/dig, buried lids, difficult access, after-hours, weekend/same-day, disposal surcharges, or additional tanks/compartments may be billed as extras at AHS rates.
- Quotes & pricing. Quotes are estimates unless marked “fixed price.” Pumping prices assume accessible lids on a regular weekday. Prices may change if site conditions differ from what Customer described. Sales tax applies when required by law.
- Payment. Payment is due upon completion unless the invoice states another due date. Accepted methods: cash, check, card (card may include a processing fee), or other method AHS approves. Past-due balances may accrue interest at 1.5% per month (18% APR) or the maximum allowed by Michigan law, whichever is less, plus reasonable collection costs and attorney fees. AHS may suspend or refuse further service if payment is late.
- Deposits & cancellations. Deposits are non-refundable after materials are ordered or a crew/day is reserved, except as required by law. Customer cancellations with less than 24 hours’ notice (or after the truck is en route) may be charged a trip/cancellation fee. Weather, access, or safety issues may require rescheduling without liability to AHS.
- Access & site readiness. Customer must provide safe vehicle/equipment access, unlocked gates, clear work areas, and someone on site or reachable by phone. Customer must uncover lids when required or pay locate/dig fees. Pets must be secured. AHS may leave and charge a trip fee if the site is not ready or unsafe.
- MISSDIG / utilities (excavation & dig work). For dig/excavation work, Customer is responsible for timely MISSDIG811 locates (811 / 800-482-7171 / oca.missdig811.org) and for disclosing private lines (irrigation, propane, electric to outbuildings, well lines, invisible fence, drain tile, etc.). Customer holds AHS harmless for damage to unmarked or privately owned underground features not properly disclosed/marked.
- Property impact. Septic work can disturb lawn, landscaping, driveways, and soft ground. AHS will use reasonable care but is not responsible for landscaping restoration, sod, gardens, decorative rock, irrigation, or settling unless separately quoted in writing.
- Septic systems & results. AHS performs services in a workmanlike manner consistent with industry practice. Pumping empties accessible tank contents; it does not guarantee future system performance, drainfield life, or absence of backups. Repairs address observed conditions; additional failures can appear after opening a system. AHS’s obligations are best-efforts service obligations, not a guarantee of a particular result, except any express written warranty AHS issues for a specific part/install.
- Health department / permits. Customer is responsible for permits, applications, and health-department requirements unless AHS expressly agrees in writing to obtain them. Work may be delayed until permits/approvals are provided.
- Waste & disposal. Septage is disposed of at lawful facilities. Disposal fees and surcharges imposed by facilities or regulators may be passed through to Customer.
- Limitation of liability. To the fullest extent permitted by law, AHS’s total liability for any claim arising out of the services is limited to the amount Customer paid AHS for the specific job giving rise to the claim. AHS is not liable for indirect, incidental, special, or consequential damages (including lodging, lost rent, business interruption, or personal property inside the home) except for damages caused by AHS’s gross negligence or willful misconduct. Nothing here limits liability that cannot be limited under Michigan law.
- Claims. Customer must notify AHS in writing of any claim within 14 days after service (or discovery of the issue, if later), and in no event later than the period required by law. Timely notice helps AHS investigate.
- Photos & records. Customer authorizes AHS to take job-site photos/videos for documentation, insurance, training, and quality control. AHS may use non-identifying work photos for marketing unless Customer objects in writing.
- Customer warranties. Customer warrants they are the property owner or authorized agent, that information provided (tank size, lid location, backups, prior work) is accurate, and that AHS may enter the property to perform the work.
- Collection & lien rights. If amounts remain unpaid more than 30 days after the due date, AHS may use a collection agency or attorney; Customer pays reasonable collection costs and attorney fees. AHS reserves all lien and security rights available under Michigan law for unpaid labor/materials.
- Governing law. These Terms are governed by the laws of the State of Michigan. Venue for disputes is in the state courts of Berrien County, Michigan, unless AHS agrees otherwise in writing.
- Severability. If any provision is unenforceable, the rest remain in effect.
